BenCreatesBooks LLC Terms of Service.

These terms govern the services provided by BenCreatesBooks LLC ("the Studio", "we", "us") through https://www.bencreatesbooks.com and direct engagements with clients. By booking a service or buying a digital product, you agree to these terms.

Our services

The Studio provides book cover design, book interior design and formatting, publishing company and imprint setup, publishing and distribution assistance, author branding, author website design, and book launch support. Prices shown on the Site are starting prices. The final price for a project is the written quote we agree with you before work begins.

Booking and payment

• A project is booked when the scope is agreed in writing and the deposit or first milestone payment has been received.
• Unless a proposal states otherwise, projects are billed in stages: a deposit before work begins and the balance as stages complete or before final files are released.
• Third-party costs used on your project, such as ISBNs, stock imagery licences, domain names, advertising spend, and booked promotions, are charged at cost and are not refundable once paid out. See our Refund Policy.

What we need from you

You agree to provide the materials your project needs (for example, your final manuscript, text, and brand assets), confirm that you hold the rights to use everything you send us, and give feedback within a reasonable time. Timelines are good-faith estimates; if materials or approvals are delayed, delivery dates move by at least the length of the delay.

Revisions

Each service includes the revision rounds described in its package or proposal. Requests beyond the included rounds, or changes to an approved direction, are quoted before we do the extra work.

Intellectual property

When a project is paid in full, the final delivered files are yours to use for the book or brand they were made for. Our working files, templates, and production methods remain the Studio's property unless we agree otherwise in writing. You keep all rights in your manuscript and content at all times; nothing in these terms transfers them to us. Unless you tell us otherwise in writing, we may show finished covers and project work in our portfolio and marketing.

Digital products

Digital products (templates, kits, themes, and guides) are sold through our store on Payhip under the licence shown on each product page: one buyer, use in your own projects, no resale or redistribution of the files themselves. Digital product sales are final; see the Refund Policy for the exceptions.

Liability

Our total liability for any project is limited to the fees you paid us for that project. We are not liable for indirect losses, such as lost sales or lost profits. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Wyoming, United States.
